Your Peace of Mind
The HITECH Act that was signed into law in
February 2009, directed Health and Human
Services to develop guidance and regulations to
deal with breach. Regulations were published in
August 2009 and HHS began enforcement of
breach in February 2010.
At TMC, we now have one whole year of
experience in dealing with various HIPAA
breaches, and can share with you what we
know through our programs and services.

1. A breach applies only to our
electronic records.
2. If the server in my office is
hacked, stolen or otherwise
compromised, the practice
does not have a breach if
proprietary software that
cannot be accessed is used
even if it is not encrypted.
3. Encryption is needed for
portable devices such as
laptops with PHI but not for
PHI that never leaves my
office.
4. My Business Associates are
now responsible to HHS for
compliance with HIPAA and
subject to all fines and
penalties.
5. If there is an inadvertent disclosure
of PHI by a person who is not
authorized to access PHI, the
disclosure will still be a “breach”
even if the PHI is not further used
or disclosed in a manner that
violates the Privacy Rules.
6. Practices are required by law toreport all breaches to the patient
and HHS.
7. Multiple State & Federal laws have
breach notification requirements.
8. If a breach affects 500 or more
individuals, the covered entity (not
the business associate) must notify
“prominent media outlets” in the
relevant state or jurisdiction.

The move is official for our new office in Alpharetta. We are now located just over a mile down the road from our previous location in Alpharetta. Our new office is located at 13010 Morris Road BLDG I Suite 600 Alpharetta, GA 30004.

As Mobile IT Solutions continues to grow and continues to look at how to better support our clients we have decided to Move our Alpharetta/Atlanta office 1.13 miles down the road. This move provides a better office for our employees and better parking and amenities for our clients that visit us. We will be making the move the week of October 11th 2010 and look forward to having our new facility available after then.
